Applies To: Rise Radio's websites, retailer dashboard/web app, in‑store Player Device and streaming service telemetry, and our customer support and communications (collectively, the "Services").
This Privacy Policy explains how Rise Radio LLC ("Rise Radio," "we," "us") collects, uses, discloses, and protects information in connection with the Services.
Who this is for. Our Services are designed for U.S. businesses (e.g., independently owned retailers) and their authorized users. This policy also applies to individuals who contact us through our website (including consumers and advertisers).
What we do not do. We do not collect or store in‑store audio from the premises (the Player Device has no microphone and does not record). We also do not collect payment card or bank account information directly; billing is administered through program invoicing/EDI.
1) Key Definitions
"Retailer": a store operator that enrolls in the Services.
"Approved Premises": the specific store address you provide that is approved for use of the in‑store Programming.
"Player Device": the internet streaming device used to play Programming at an Approved Premises.
"Programming": the audio stream provided by Rise Radio for in‑store playback.
"Submitted Content": content you upload or provide (e.g., custom announcements/ads/audio files) for inclusion in Programming.
2) Information We Collect
A. Information you provide to us
Depending on how you interact with us, we may collect:
- Contact information: name, email address, phone number, job title/role.
- Store and account information: store name, store address(es), store/member identifiers (e.g., store number/account number/member ID), and related enrollment details.
- Communications: messages you send us (emails, support tickets, chat messages, or other communications).
- Submitted Content: audio files (e.g., MP3/WAV), scripts, and related metadata you upload or provide through the dashboard.
- Advertiser/vendor inquiries: contact details and information about proposed advertising campaigns (if you contact us as an advertiser or vendor).
B. Information we collect automatically (device, web, and app data)
When you use the Services, we may automatically collect:
- Website/app usage and log data: IP address, browser type, device type, pages viewed, referring/exit pages, timestamps, and similar diagnostic data.
- Security and anti‑abuse signals: we use tools such as Google reCAPTCHA to help prevent spam and abuse. reCAPTCHA may collect certain information from your device/browser (including cookies and other signals) as part of its security function.
- Player Device telemetry (no audio recording), including:
- a unique device identifier
- IP address used by the Player Device (which may be used to infer approximate location and to help ensure the device is used within authorized U.S. territories)
- playback logs (e.g., stream start/stop, track/program identifiers, timestamps)
- device "heartbeat"/uptime indicators
- connectivity details (Wi‑Fi vs. Ethernet, signal/connection status)
- error logs and diagnostics
Important: The Player Device does not record or store audio from your premises and has no microphone.
C. Information we receive from third parties
We may receive information from:
- Program administrators / cooperatives and affiliates (including True Value and affiliated entities such as Do it Best Group / Do it Best Corp) related to enrollment, store identifiers, invoicing administration, and credits.
- Service providers we use to operate our business systems (for example, CRM/helpdesk, internal communications, or project management tools).
- Advertising partners/vendors in connection with campaign administration (for example, ad schedules or creative approvals).
3) How We Use Information
We use information for purposes consistent with operating the Services, including to:
Provide and operate the Services
- create and manage accounts
- deliver Programming and provide dashboard features
- configure and support Player Devices
Troubleshoot and support
- diagnose technical issues using device telemetry (e.g., errors, connectivity status)
- respond to requests and provide customer support
Program administration, licensing, and compliance
- associate services with an Approved Premises
- help ensure use within authorized U.S. territories
- support licensing and reporting obligations related to music/public performance
Advertising and measurement
- enable ad selection/participation and campaign administration
- generate and share proof‑of‑performance reporting (e.g., airtimes, playlists, campaign playback metrics) where applicable
Communications
- send service messages and operational notices (e.g., onboarding, support updates, device issues, changes to terms/policies)
Security and fraud prevention
- protect the Services from spam, abuse, fraud, and unauthorized access
Improve and develop the Services
- analyze performance and usage trends (including through analytics, where enabled)
Marketing (limited)
- if you request information or opt in, we may send marketing communications. You can opt out at any time (see Section 9).
Legal and business purposes
- comply with laws and legal requests
- enforce agreements and protect rights, safety, and property
- support business transactions (e.g., merger, acquisition, restructuring)
4) How We Disclose Information
A. To program administrators / cooperatives and affiliates
We may share store‑level and account information with the Co‑op and affiliated entities as reasonably necessary to administer the program, including (as applicable):
- enrollment status
- store identifiers (e.g., member IDs, store numbers)
- invoicing/credit administration information
- device status/health and service usage logs
- advertising participation/selections
- proof‑of‑performance reporting and revenue share/credit reporting
B. To Performance Rights Organizations (PROs) and licensors
We may disclose information needed for licensing and reporting (which may include store/location identifiers and Approved Premises address information), to entities such as:
- ASCAP, BMI, SESAC, GMR, SoundExchange
- and other licensors or rights‑related entities as needed.
C. To vendors/advertisers and campaign partners
If you participate in advertising or vendor programs, we may share campaign performance information such as proof‑of‑performance (e.g., airtimes, playlists, and related metrics) with advertisers/vendors and related campaign partners.
D. To service providers
We use third‑party service providers to help operate and administer the Services and our business (e.g., hosting, support tools, CRM/helpdesk, collaboration and project management systems). These providers process information on our behalf for the purposes we specify. Examples may include tools such as Zoho, Trello, and Slack, among others.
E. For legal, safety, and rights reasons
We may disclose information if we believe it is reasonably necessary to:
- comply with applicable law, regulation, legal process, or lawful governmental request
- protect the rights, property, or safety of Rise Radio, our customers, the Co‑op, or others
- prevent or investigate fraud, abuse, or security incidents
- enforce our agreements, policies, and terms
F. In connection with business transactions
If Rise Radio is involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, information may be disclosed or transferred as part of that transaction, subject to standard confidentiality protections.
G. Aggregated or de‑identified information
We may create and disclose aggregated or de‑identified information that cannot reasonably be used to identify an individual.
5) Cookies, reCAPTCHA, and Analytics
A. Cookies and similar technologies
We and our service providers may use cookies and similar technologies for:
- security (including fraud prevention and bot detection)
- site functionality (e.g., keeping you logged in)
- basic analytics and performance measurement (where enabled)
B. reCAPTCHA
We use Google reCAPTCHA to protect our forms and Services from abuse. reCAPTCHA may collect information from your browser/device (including cookies and other signals) to determine whether activity is automated. Your use of reCAPTCHA is subject to Google's privacy terms.
C. Analytics and pixels
We currently use basic analytics. We may implement additional analytics tools and/or tags (for example, Google Analytics/Tag Manager, Meta Pixel, or LinkedIn Insight Tag) in the future. If we do, we will update this Privacy Policy and, where required by law, provide additional notice and choices.
D. Your cookie choices
You can control cookies through your browser settings. Note that disabling cookies may affect functionality. Where required by law, we will provide additional controls (e.g., consent banners).
6) Call Recording
We may record and/or monitor phone calls for quality assurance, training, and support. Where required by law, we will obtain consent before recording.
If you do not want a call recorded, please contact us through alternative support channels (e.g., email or ticket portal) instead of calling.
7) Submitted Content and Content Review
If you upload Submitted Content (including audio files):
- we may process, store, and transmit that content as necessary to operate the Services
- we may perform technical checks (e.g., file type/encoding, malware scanning)
- we may review content for operational reasons (e.g., ensuring it functions in the stream and aligns with our platform usage standards)
No guarantee of review. We do not promise to review all Submitted Content for legality, rights clearance, "appropriateness," or audio quality, and you remain responsible for the content you upload and the permissions you have obtained.
8) Data Retention
We retain information for as long as reasonably necessary for the purposes described in this Policy, including:
- providing the Services
- maintaining records for accounting and program administration
- complying with legal obligations
- resolving disputes and enforcing agreements
Retention periods may vary by data type and context. We may retain certain information in backups for a limited period even after deletion requests, consistent with standard backup practices.
9) Your Choices
A. Account information
Retailers and Authorized Users may be able to access and update certain account information through the dashboard or by contacting us.
B. Marketing communications
If you receive marketing emails from us, you can opt out using the unsubscribe link in the message or by contacting us. Even if you opt out of marketing, we may still send transactional/operational messages (e.g., support updates, service notices).

10) U.S. Privacy Rights and Requests
Depending on your state of residence, you may have legal rights regarding your personal information (for example, the right to request access, deletion, correction, or information about disclosures).

Subject to verification and applicable law, you may be able to request:
- Access to personal information we maintain about you
- Correction of inaccurate personal information
- Deletion of personal information
- Portability (a copy of certain information in a usable format)
- Opt‑out of certain processing (e.g., targeted advertising) if applicable

C. Appeals (recommended / where required)
If we deny your request, you may appeal by replying to our denial email or contacting us again at privacy@riseradio.com with the subject line "Privacy Appeal." We will respond within the timeframe required by applicable law.
11) "Sale" and "Sharing" of Personal Information; Targeted Advertising
We do not sell personal information.
We do not currently share personal information for cross‑context behavioral advertising (also called "targeted advertising" or "retargeting").
If our practices change (for example, if we deploy advertising pixels for retargeting), we will update this Privacy Policy and provide any required opt‑out mechanisms.
12) Security
We maintain commercially reasonable administrative, technical, and physical safeguards designed to protect information. However, no security measures are perfect, and we cannot guarantee absolute security.
13) Children's Privacy
The Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided personal information to us, contact us and we will take appropriate steps to delete it.
14) International Visitors
Our Services are intended for U.S. businesses. If you access the Services from outside the United States (for example, as an international advertiser contacting us), you understand that your information may be processed and stored in the United States, which may have different data protection laws than your jurisdiction.
15) Third-Party Links and Services
Our Services may contain links to third‑party websites or services. This Privacy Policy does not apply to those third parties. We encourage you to review their privacy policies.
16) Changes to This Privacy Policy
We may update this Privacy Policy from time to time. We will post the updated policy on this page and update the "Last Updated" date above. If changes are material, we may provide additional notice through the dashboard, email, or other reasonable means.
